What if I change my mind?\u201d<\/p>\n<p data-start=\"2084\" data-end=\"2388\">In South Africa\u2019s labour world, the <strong data-start=\"2120\" data-end=\"2137\">notice period<\/strong> is a small window where things can get messy if you don\u2019t know your rights. This blog dives into what you <em data-start=\"2244\" data-end=\"2249\">can<\/em> and <em data-start=\"2254\" data-end=\"2261\">can\u2019t<\/em> do during notice \u2014 from both employee and employer sides \u2014 with a clear, practical understanding for real workplaces here in SA.<\/p>\n<p data-start=\"2390\" data-end=\"2406\">Let\u2019s unpack it.<\/p>\n<h2 data-start=\"2413\" data-end=\"2464\">What does the law say: the baseline under BCEA<\/h2>\n<p data-start=\"2466\" data-end=\"2690\">The Basic Conditions of Employment Act (BCEA) sets minimum notice period rights in South Africa. These are the legal floor\u2014your contract or agreement can give you more, but never less.<\/p>\n<p data-start=\"2692\" data-end=\"2712\">Here\u2019s the standard:<\/p>\n<ul data-start=\"2714\" data-end=\"3104\">\n<li data-start=\"2714\" data-end=\"2833\">\n<p data-start=\"2716\" data-end=\"2833\">If you\u2019ve worked <strong data-start=\"2733\" data-end=\"2755\">six months or less<\/strong>, you must give <strong data-start=\"2771\" data-end=\"2792\">one week\u2019s notice<\/strong>.<\/p>\n<\/li>\n<li data-start=\"2834\" data-end=\"2980\">\n<p data-start=\"2836\" data-end=\"2980\">If you\u2019ve been employed more than six months but <strong data-start=\"2885\" data-end=\"2911\">not more than one year<\/strong>, then <strong data-start=\"2918\" data-end=\"2939\">two weeks\u2019 notice<\/strong>.<\/p>\n<\/li>\n<li data-start=\"2981\" data-end=\"3104\">\n<p data-start=\"2983\" data-end=\"3104\">If you\u2019ve worked for <strong data-start=\"3004\" data-end=\"3024\">one year or more<\/strong>, the minimum is <strong data-start=\"3041\" data-end=\"3063\">four weeks\u2019 notice<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3106\" data-end=\"3331\">These notice periods also usually apply equally to employer and employee: you can\u2019t be required to give longer notice than your employer has to give you, unless you both agreed on that.<\/p>\n<p data-start=\"3333\" data-end=\"3520\">One twist: a <em data-start=\"3346\" data-end=\"3368\">collective agreement<\/em> can reduce the four-week notice minimum to two weeks for some employees, but only if that agreement is valid.<\/p>\n<p data-start=\"3522\" data-end=\"3697\">Also, notice must generally be given <strong data-start=\"3559\" data-end=\"3573\">in writing<\/strong>, except when dealing with workers who are illiterate or otherwise can\u2019t read\/write.<\/p>\n<p data-start=\"3699\" data-end=\"3912\">Finally, the law prohibits giving notice during a period of leave, or making the notice period run at the same time as leave (except for sick leave) in most circumstances.<\/p>\n<h2 data-start=\"3919\" data-end=\"3982\">What you <em data-start=\"3931\" data-end=\"3936\">can<\/em> do as an employee during your notice period<\/h2>\n<h3 data-start=\"3984\" data-end=\"4032\">Serve it (work it), or ask for pay in lieu<\/h3>\n<p data-start=\"4034\" data-end=\"4427\">Legally, you must intend to serve your notice (do the work), unless your employer says otherwise. If your employer doesn\u2019t want you to actually come in (perhaps for confidentiality or business reasons), they may <strong data-start=\"4286\" data-end=\"4315\">pay you in lieu of notice<\/strong>\u2014meaning you\u2019re paid for the notice period but don\u2019t actually work it.<\/p>\n<p data-start=\"4429\" data-end=\"4609\">If you, the employee, refuse to work the notice period, the employer is generally <strong data-start=\"4511\" data-end=\"4526\">not obliged<\/strong> to pay you for the days you didn\u2019t work.<\/p>\n<h3 data-start=\"4611\" data-end=\"4648\">Take leave during notice period<\/h3>\n<p data-start=\"4650\" data-end=\"4916\">Taking leave (especially annual leave) during a notice period is generally not allowed unless the employer agrees. The law says an employer cannot require or allow the employee to take annual leave during that notice period.<\/p>\n<p data-start=\"4918\" data-end=\"5084\">Sick leave is the exception: if you have sick days and fall ill during your notice period, you can take sick leave as usual.<\/p>\n<h3 data-start=\"5086\" data-end=\"5117\">Withdraw your resignation<\/h3>\n<p data-start=\"5119\" data-end=\"5403\">Once you resign in writing, it\u2019s usually final. The law states that the <a href=\"https:\/\/bizcraft.co.za\/blog\/complete-guide-to-job-resignations-south-africa\/\">resignation<\/a> is effective immediately upon being given and doesn\u2019t require employer acceptance. You can ask to withdraw, but the employer is not obligated to accept your request.<\/p>\n<h3 data-start=\"5405\" data-end=\"5451\">Resign with immediate effect (no notice)<\/h3>\n<p data-start=\"5453\" data-end=\"5873\">Sometimes people feel they have no option but to leave immediately, especially under very toxic or illegal circumstances. But this is risky: you&#8217;ll need strong proof, and not all such resignations succeed legally.<\/p>\n<p data-start=\"5875\" data-end=\"6039\">You generally can\u2019t just bail out without reason. Doing so may breach the contract and lead to claims against you for damages.<\/p>\n<hr data-start=\"6041\" data-end=\"6044\" \/>\n<h2 data-start=\"6046\" data-end=\"6100\">What employers <em data-start=\"6064\" data-end=\"6069\">can<\/em> and <em data-start=\"6074\" data-end=\"6081\">can\u2019t<\/em> do during notice<\/h2>\n<h3 data-start=\"6102\" data-end=\"6132\">Give notice during leave<\/h3>\n<p data-start=\"6134\" data-end=\"6420\">Employers are <strong data-start=\"6148\" data-end=\"6163\">not allowed<\/strong> to issue notice of termination (including dismissal) while an employee is on their statutory leave (annual, maternity, family responsibility) or have the notice run concurrently with that leave (except sick leave).<\/p>\n<p data-start=\"6422\" data-end=\"6584\">You also shouldn&#8217;t be forced to use your annual leave in the notice period; any unused leave must generally be paid out.<\/p>\n<h3 data-start=\"6586\" data-end=\"6649\">Force the employee to exit before notice ends without pay<\/h3>\n<p data-start=\"6651\" data-end=\"6888\">If the employer wants you out early, they may ask you to leave before the end of notice, but they must <strong data-start=\"6754\" data-end=\"6783\">pay you for the remainder<\/strong> (pay in lieu). They cannot simply kick you out without paying.<\/p>\n<h3 data-start=\"6890\" data-end=\"6959\">Hold disciplinary hearings after the resignation has been handed in<\/h3>\n<p data-start=\"6961\" data-end=\"7163\">Even if you\u2019ve resigned in writing, you are still an employee until the notice period ends. That means disciplinary hearings may still proceed during that time.<\/p>\n<h3 data-start=\"7165\" data-end=\"7208\">Make deductions in breach of contract<\/h3>\n<p data-start=\"7210\" data-end=\"7488\">Employers cannot deduct from your pay without your written consent, unless it\u2019s legally allowed. That means they can&#8217;t withhold your final salary or leave pay as punishment for failing to serve full notice (unless there\u2019s an agreement).<\/p>\n<h2 data-start=\"7495\" data-end=\"7531\">Real-life issues &amp; \u201cgrey zones\u201d<\/h2>\n<h3 data-start=\"7533\" data-end=\"7585\">What \u201ccalendar month\u201d vs \u201c30-day notice\u201d means<\/h3>\n<p data-start=\"7587\" data-end=\"8014\">Sometimes contracts say \u201cone calendar month\u2019s notice.\u201d That term can be ambiguous. Does it mean from 10 October to 10 November, or the entire month of October? Labour law commentators note that courts may interpret \u201ccalendar month\u201d based on intention. If the contract is unclear, you may argue for the interpretation that\u2019s fair to you. It\u2019s always better if the contract spells this out clearly.<\/p>\n<h3 data-start=\"8016\" data-end=\"8047\">Combined leave and notice<\/h3>\n<p data-start=\"8049\" data-end=\"8342\">Some employers try to force employees to take outstanding annual leave during notice, or make notice run concurrently with leave. The law says that\u2019s generally not allowed. If your employer does this, you can insist on pay for unused leave separately.<\/p>\n<h3 data-start=\"8344\" data-end=\"8387\">Contradictory contract notice periods<\/h3>\n<p data-start=\"8389\" data-end=\"8680\">If your contract requires long notice (e.g. two months) but the <a href=\"https:\/\/bizcraft.co.za\/blog\/basic-employee-rights\/\">BCEA<\/a> minimum is lower, the contract term is valid <em data-start=\"8499\" data-end=\"8508\">only if<\/em> it applies equally to employer and employee. Can they make notice run while I\u2019m on leave?<\/strong><br data-start=\"9086\" data-end=\"9089\" \/>A: No. The law prohibits giving notice during annual leave or making notice run concurrently with leave.
