What it does is bring clarity, much more detailed guidance, and better alignment with recent case law and workplace realities.<\/p>\n<p data-start=\"982\" data-end=\"1145\">If you&#8217;re an employee, a manager, or just someone who wants to know their rights, this new Code affects you. Here\u2019s what\u2019s new, what stays, and how you should act.<\/p>\n<h2 data-start=\"1152\" data-end=\"1181\">Why this update was needed<\/h2>\n<p data-start=\"1183\" data-end=\"1534\">Over time, South Africa\u2019s courts have shaped dismissal law through judgments and precedents. Some of those principles were implicitly accepted, even though they weren\u2019t in the old Code. The result: ambiguity. Employers found themselves guessing which standard to follow. One unified Code, clearer structure<\/h3>\n<p data-start=\"2370\" data-end=\"2575\">Instead of multiple dismissal-related codes, all dismissal rules and guidance are now in <strong data-start=\"2459\" data-end=\"2471\">one Code<\/strong>. Emphasis on documentation, evidence, and consistency<\/h3>\n<p data-start=\"5942\" data-end=\"6278\">With more detailed rules comes more expectation around <strong data-start=\"5997\" data-end=\"6008\">records<\/strong>. You have a statutory right to process fairness and reasonableness of the employer\u2019s decision. If either substantive or procedural fairness fails, the dismissal may be challenged at the CCMA or bargaining council.<\/p>\n<h3 data-start=\"7654\" data-end=\"7679\">Understand the ground<\/h3>\n<p data-start=\"7681\" data-end=\"7979\">If you are dismissed, ask: on which ground (misconduct, incapacity, operational requirements)? Make sure the employer gives you that in writing with sufficient detail so you understand what they say you did wrong (allegations) or where your performance was lacking. If that\u2019s vague, challenge it.<\/p>\n<h3 data-start=\"7981\" data-end=\"8015\">Exercise your right to respond<\/h3>\n<p data-start=\"8017\" data-end=\"8264\">Don\u2019t treat the employer\u2019s case as fixed. The Code guarantees you a chance to respond. Use that. Submit your side, raise alternative explanations, ask for documentation, ask for clarification. Without them, you can\u2019t properly defend or respond. If your employer withholds, that is a red flag. If the matter goes to arbitration, that failure may weigh heavily against the employer.<\/p>\n<h3 data-start=\"8534\" data-end=\"8555\">Check consistency<\/h3>\n<p data-start=\"8557\" data-end=\"8728\">If others in similar circumstances were disciplined less harshly, ask why. Replace references to the old Code or Schedule 8 with the new Code. Make sure your rules (misconduct, performance standards, incapacity, retrenchment rules) are clear, reasonable, and consistent with the new Code.<\/p>\n<h3 data-start=\"9638\" data-end=\"9676\">Train managers and decision-makers<\/h3>\n<p data-start=\"9678\" data-end=\"9886\">Those who make dismissal decisions have to know the new rules: what is \u201creasonable,\u201d how to run a fair process, how to justify deviations, how to document, how to consult. Mistakes at the outset cost a lot.<\/p>\n<h3 data-start=\"9888\" data-end=\"9926\">Document everything \u2014 from day one<\/h3>\n<p data-start=\"9928\" data-end=\"10095\">Warnings, investigations, meetings, letters, notes, correspondence: keep them. If a dismissal is challenged, the quality of your records can make or break your case.<\/p>\n<h3 data-start=\"10097\" data-end=\"10139\">Ensure fairness even when you simplify<\/h3>\n<p data-start=\"10141\" data-end=\"10338\">If you\u2019re a small employer and opt for a simpler process, make sure the essence of fairness is intact: notice, chance to respond, representation, reasonability. Be ready to explain your approach.<\/p>\n<h3 data-start=\"10340\" data-end=\"10383\">Be mindful of consistency but not rigid<\/h3>\n<p data-start=\"10385\" data-end=\"10586\">Fairness requires consistency, but real life may justify differentiation. If you treat two similar misconducts differently, have a clear rationale (seniority, damage caused, cooperation, mitigation).<\/p>\n<h3 data-start=\"10588\" data-end=\"10623\">In retrenchments, engage deeply<\/h3>\n<p data-start=\"10625\" data-end=\"10811\">Don\u2019t skirt the consultation. Offer alternatives, be transparent with criteria, disclose the rationale, explore redeployment, provide severance, and offer re-employment where possible.<\/p>\n<h3 data-start=\"10813\" data-end=\"10858\">Watch the standard of deviation carefully<\/h3>\n<p data-start=\"10860\" data-end=\"11022\">The Code allows deviation from formal procedure in <strong data-start=\"10911\" data-end=\"10932\">exceptional cases<\/strong>, but you must justify it. Don\u2019t assume you can skip steps just because it\u2019s convenient.<\/p>\n<h2 data-start=\"11029\" data-end=\"11062\">Some common questions answered<\/h2>\n<p data-start=\"11064\" data-end=\"11374\"><strong data-start=\"11064\" data-end=\"11131\">Can someone still be dismissed on the spot (instant dismissal)?<\/strong><br data-start=\"11131\" data-end=\"11134\" \/>Yes \u2014 but only for very serious misconduct where the nature of the act makes continued employment intolerable (for example, gross theft, violence). Even then, the new Code demands a fair process as far as possible under the circumstances.<\/p>\n<p data-start=\"11376\" data-end=\"11607\"><strong data-start=\"11376\" data-end=\"11418\">Must every dismissal follow a hearing?<\/strong><br data-start=\"11418\" data-end=\"11421\" \/>Not necessarily. The new Code allows informal processes in some instances \u2014 but only when justified. A formal hearing is still often best practice, especially in higher stakes matters.<\/p>\n<p data-start=\"11609\" data-end=\"11884\"><strong data-start=\"11609\" data-end=\"11668\">If I&#8217;m under probation, can I be dismissed more easily?<\/strong><br data-start=\"11668\" data-end=\"11671\" \/>Yes, the evidentiary threshold is somewhat lower in probation periods. But that doesn\u2019t mean no process. You still must give notice, an opportunity to respond, explain your reasoning, and treat probation fairly.<\/p>\n<p data-start=\"11886\" data-end=\"12091\"><strong data-start=\"11886\" data-end=\"11920\">How much notice must be given?<\/strong><br data-start=\"11920\" data-end=\"11923\" \/>Notice periods still depend largely on contract or BCEA rules, but the new Code expects reasonable timing in dismissal processes, response windows, and consultations.<\/p>\n<p data-start=\"12093\" data-end=\"12266\"><strong data-start=\"12093\" data-end=\"12128\">Can you deviate from procedure?<\/strong><br data-start=\"12128\" data-end=\"12131\" \/>Yes, in exceptional, justified circumstances \u2014 but deviation must be explained, documented, and proportionate. It is not a free pass.<\/p>\n<h2 data-start=\"12273\" data-end=\"12315\">Hypothetical examples to make this real<\/h2>\n<h3 data-start=\"12317\" data-end=\"12360\">Example 1: Misconduct in a retail store<\/h3>\n<p data-start=\"12362\" data-end=\"12611\">Thandi works at a clothing store. She\u2019s caught using a coworker discount for her own family shopping without permission. Under the old code, the employer gave her a warning, asked for written statement, and later dismissed her for repeat misconduct.<\/p>\n<p data-start=\"12613\" data-end=\"13041\">Under the new Code, the employer must show that the rule was known and reasonable, that the harm or potential harm is significant, and whether a less serious sanction might have sufficed. Thandi must have had the chance to respond. If the employer skipped telling her the allegation in writing, or didn\u2019t allow her to answer, or disciplined another employee more mildly without explanation, Thandi could challenge the dismissal.<\/p>\n<h3 data-start=\"13043\" data-end=\"13096\">Example 2: Poor performance in a programming role<\/h3>\n<p data-start=\"13098\" data-end=\"13553\">Sipho\u2019s coding has lagged. His tasks are delayed, bugs abound. Under the new Code, the employer must show that tasks were reasonable, that Sipho had training or support, an opportunity to improve, clear standards, and that dismissal was proportionate. Suppose Sipho is a senior developer. In that case, the employer might not need to issue multiple warnings if Sipho\u2019s role implies higher standard of accountability \u2014 as long as due process is followed.<\/p>\n<h3 data-start=\"13555\" data-end=\"13602\">Example 3: Retrenchment at a small business<\/h3>\n<p data-start=\"13604\" data-end=\"13989\">A small caf\u00e9 with limited capital must cut staff. Under the new Code, because the employer is small, they may adopt a less formal process. Yet they must still issue a Section 189(3) notice, consult meaningfully, share selection criteria, and explore alternatives. Suppose they pick staff arbitrarily\u2014without justifying criteria or documentation\u2014that could make the retrenchment unfair.<\/p>\n<h2 data-start=\"13996\" data-end=\"14031\">Final thoughts: The path forward<\/h2>\n<p data-start=\"14033\" data-end=\"14302\">The 2025 Code of Good Practice on Dismissal brings South African dismissal law closer to how workplaces already operate. It introduces clarity, encourages fairness, and acknowledges that one size does not always fit all. But make no mistake: the new demands are higher.<\/p>\n<p data-start=\"14304\" data-end=\"14456\">For employees, the new Code gives you sharper tools to hold employers to account. Be methodical, ask for proper procedure, and assert your rights early.<\/p>\n<p data-start=\"14458\" data-end=\"14670\">For employers, this is a moment to get your HR house in order. Revise your policies, train your decision-makers, keep detailed records, and treat every dismissal as a delicate operation, not a routine admin task.<\/p>\n<p data-start=\"14672\" data-end=\"14843\">If any dismissal process comes your way, don\u2019t go in blind. Know the new rules. Prepare your case or your defence.
